These Terms of Service ("Terms") govern your access to and use of MyFitnessTech (the "App," "Service") provided by Fitness Tech ("we," "us," "our"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use MyFitnessTech. If you are between 13 and the age of majority in your jurisdiction, you may use the Service only with the consent of a parent or guardian. By using the Service, you represent that you meet these requirements.
MyFitnessTech is a fitness, nutrition, sleep, and wellness tracking application. The Service may include:
We may add, change, or remove features at any time. We will give reasonable notice for material changes that affect features you actively use.
To use the Service you must create an account using a supported sign-in method (email + password, Sign In with Apple, or Sign In with Google). You agree to:
You are responsible for activity that occurs under your account. We may suspend or terminate accounts that we reasonably believe were created with false information or are being used to violate these Terms.
MyFitnessTech is a fitness tracking and personal logging tool. It is not a medical device, and we are not licensed health-care providers.
You assume all responsibility and risk for your use of MyFitnessTech and any actions you take based on data shown in the App.
The Service offers optional one-time in-app purchases for cosmetic upgrades:
The Service also offers an optional auto-renewing subscription, AI Pro, which is described separately in Section 6.
The following terms apply to all in-app purchases, including the AI Pro subscription:
Purchases made through the App Store are additionally governed by Apple's Standard End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula.
MyFitnessTech offers one optional auto-renewing subscription, AI Pro, sold in the MyFitnessTech Pro subscription group. Two plans are available:
Both plans unlock exactly the same features; the annual plan is simply billed once a year. The prices above are the United States prices. The price shown in the App is the price reported by the App Store or Google Play for your region and currency.
What AI Pro unlocks. AI Pro unlocks AI food scanning — point your camera at a meal or at a nutrition label and the App returns estimated calories and macronutrients — along with AI features we add in the future.
Free AI scans. Every account includes 3 free AI scans in total. This is a lifetime allowance for the account, not a monthly one. Once those 3 scans are used, AI features require an active AI Pro subscription. Everything else in MyFitnessTech — workout tracking, manual nutrition logging, sleep, weight, progress, and the social features — is free and does not require a subscription.
The following terms apply to AI Pro purchased through the App Store:
AI Pro purchased through Google Play works the same way, except that payment is charged to your Google Play account and you manage or cancel the subscription in the Google Play Store's subscription settings.
Price changes. We may change the price of AI Pro. If we do, we will give you notice beforehand, and the new price applies only from your next renewal onward — never retroactively to a period you have already been charged for. If you do not want to continue at the new price, you can turn off auto-renew before that renewal date.
If you opt into the Service's social features (friends, messaging, profile photos), you may submit content including text messages, photographs, usernames, display names, and avatars ("User Content").
You retain ownership of User Content you submit. By submitting User Content, you grant Fitness Tech a worldwide, non-exclusive, royalty-free license to host, store, transmit, and display User Content solely for the purpose of operating and improving the Service.
You agree NOT to submit User Content that:
We may remove User Content, restrict access to social features, or suspend or terminate accounts that we reasonably believe violate these rules. We may cooperate with law enforcement when required by law.
You can report abuse via Settings → Social → Report User. You can block users via the same menu.
You agree NOT to:
MyFitnessTech integrates with third-party platforms including Apple Health, Google Health Connect, Apple Sign In, Google Sign-In, Firebase (Google), and RevenueCat. Your use of those services is governed by their own terms and privacy policies, which we do not control.
You may terminate your account at any time via Settings → Account → Delete Account. Deletion removes your data from our systems within 30 days, except where retention is required by law.
We may suspend or terminate your access to the Service if you violate these Terms or if we reasonably believe your account has been compromised or is being used unlawfully. We will give reasonable notice where practical.
Upon termination, your right to access the Service ends immediately. Lifetime cosmetic entitlements do not survive account termination.
Deleting your account does not cancel an active AI Pro subscription. Subscriptions are billed by Apple or Google, not by us, so we cannot cancel one on your behalf. To stop future charges you must turn off auto-renew yourself — in your Apple Account settings (Settings → your name → Subscriptions on iOS) or in the Google Play Store's subscription settings. We recommend cancelling before you delete your account.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DATA WILL BE PRESERVED OR ACCURATE. YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN BACKUPS OF DATA YOU CONSIDER IMPORTANT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL FITNESS TECH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN ANY CASE, OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FITNESS TECH IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so the above limitations may not apply to you to the extent prohibited.
You agree to indemnify and hold Fitness Tech harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of your User Content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.
We may update these Terms from time to time. If a change is material, we will give you notice in the App or by email. Continued use of the Service after the effective date of the updated Terms constitutes your acceptance. If you do not agree to the updated Terms, stop using the Service and delete your account.
These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in King County, Washington, and you consent to personal jurisdiction in those courts.
By creating a MyFitnessTech account or continuing to use the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
